Criminal Case 5
State v. J.G.
Defense Attorney: Matthew B. Nichols
Offense: Robbery and Assault
Maximum Sentence: Robbery (40 years) Assault (364 days)
Synopsis:
Client was accused of “homophobic” beating and robbery of a stranger on the street. The state’s witnesses included the alleged victim, eyewitnesses, including a citizen who received the state police chiefs’ citizen of the year award for his participation in this case (prior to trial).
The defense called one witness, Client. Client admitted assaulting the alleged victim in “homophobic” and “idiotic” response to a sexual advance, but denied any motive to rob the victim. The alleged victim denied making any sexual advance; thus his credibility on Client’s motive and intent to commit robbery was called into question.
Verdict: Not Guilty of robbery, guilty (as admitted by Client) of simple assault
